ON INTERNAL ORGANIZATION
OF THE INSURANCE AGENCY OF BOSNIA AND HERZEGOVINA
 

 

I GENERAL PROVISIONS 

 

Article 1.
(Subject of the Rulebook) 

 

The Rulebook on Internal Organization and Systematization of Staff Positions within the Insurance Agency of Bosnia and Herzegovina (hereinafter: The Rulebook) shall regulate organizational units and their scope of work, managing the Agency, planning and carrying out the tasks, rights and responsibilities of civil servants, total number of civil servants and employees, name and distribution of duties per organizational units, job descriptions for every civil servant and employee or for the group of civil servants or employees with requirements regarding their education level and other requirements of the job, the number of trainees to be employed and requirements for their employment, and other issues relating to internal organization and operations of the Agency.   

 

Article 2.
(General Principles) 

 

When the Agency performs tasks regulated by the Law and enforces the Rulebook provisions, it shall abide by the principles of legality, transparency, publicity, responsibility, efficiency and effectiveness, as well as of professional impartiality.  

 

II ORGANIZATIONAL UNITS AND THEIR JURISDICTION 

 

Article 3.
(Organizational Units)

 

For the purpose of performing the tasks of the Agency, with the seat in Sarajevo, the following organizational units shall be established:

a) Department of Legal, Administrative and Operational Affairs

b) Department of International Cooperation, Finance, Statistics and Actuarial Activities 

 

Article 4.

(Department of Legal, Administrative and Operational Affairs) 

 

The Department of Legal, Administrative and Operational Affairs shall: draft Amendments to the Law on Insurance Agency of Bosnia and Herzegovina, by-laws and other regulations pertaining to the Agency’s scope of work; monitor, plan and prepare amendments to the laws and other insurance related regulations; provide their views on draft laws and other acts proposed by one or both entities; be up to date with the regulations of the European Union and amendments to the regulations of the European Union relating to insurance; prepare and draft laws and amendments to valid laws and other acts in order to reconcile Bosnia and Herzegovina regulations with the corresponding European Union legislation; supervise implementation of the insurance related regulations; prepare instructions, decisions and findings of the Agency’s Board of Directors; coordinate activities with the Insurance Supervisory Agency of the Federation of Bosnia and Herzegovina and Insurance Agency of Republika Srpska to provide uniform implementation and interpretation of regulations pertaining to insurance and to provide equal legal protection to insurers and third parties – claimants on the territory of Bosnia and Herzegovina; prepare to resolve disputes between the insurance supervisory agencies relating to uniform interpretation and implementation of the insurance legislation at the Entity and Brcko District level; conduct its own investigations in compliance with the Law, into any activities relating to insurers, insurance companies or mediators, as well as activities of supervisory authorities in order to provide uniform implementation of insurance related legislation in each Entity and Brcko District; develop and improve communication among the Agency, entity agencies for supervision of insurance companies, insurers’ associations, actuarial associations, Green Card bureaus in Bosnia and Herzegovina; cooperate with the countries in the region and with the European Union countries; prepare reports and other documentation for Council of Ministers of Bosnia and Herzegovina; gather and analyze insurance related information; cooperate with the Ministry of Finance and Treasury of Bosnia and Herzegovina and entity ministries of finance and other institutions; provide professional and technical support to the Agency, Director and Agency Board of Directors; perform administrative duties relating to employment issues and other professional activities necessary for smooth operations of the Agency; prepare sessions, provide secretarial support; assure free access to information and unobstructed flow of information and exchange of views between the Agency and other institutions in order to perform duties under Agency’s jurisdiction; make the activities public; cooperate with the authorized civil service agencies; provide assistance to planning of training and establish insurance related training system, as well as other programs relevant for the activities of the Agency; cooperate with universities; research and prepare projects to be funded by the European Union foundations within the integration process with the European Union and strengthen the capacities of the Bosnia and Herzegovina institutions; perform tasks relating to providing funds to improve training system, prepare programs and material for training, improve access to information to every interested person, develop training systems and promote contemporary insurance related experience.  

 

Article 5.
(Department of International Cooperation, Finance, Statistics and Actuarial Activities) 

 

Department of International Cooperation, Finance, Statistics and Actuarial Activities shall perform duties and activities relating to: establishing of Bosnia and Herzegovina international relations in insurance field; protocol of cooperation with the international organizations and delegations; administrative and technical duties relevant to cooperation with international organizations and delegations; cooperation with countries in the region and European Union countries; providing all information which may be requested by the European Union pertaining to the law and practical aspect of insurance in Bosnia and Herzegovina, reconciling insurance related legislation of Bosnia and Herzegovina with the European Union legislation, representing Bosnia and Herzegovina by opening the branch offices or subsidiary companies or establishing mediators in any of the entities and third countries; coordination and cooperation between corresponding entity agencies and supervisory agencies in third countries; preparing contracts on cooperation for the purpose of exchange of information with relevant authorities in other countries; preparing and submitting information to the entity agencies; cooperation with the Green Card Bureau of Bosnia and Herzegovina; establishing, keeping and improving insurance statistics in Bosnia and Herzegovina; keeping international insurance related statistics; preparing and delivering information to the entity supervisory agencies regarding the international insurance related best practices and other information through established international relations; on behalf of Bosnia and Herzegovina submitting statistical reports on insurance to European Commission or international organizations; preparing information and statistical reports on insurance for the Council of Ministers of Bosnia and Herzegovina and other relevant institutions; monitoring and preparation of regular analyses of the existing circumstances in insurance field for all levels of government in Bosnia and Herzegovina, cooperation with Public Company Official Gazette of Bosnia and Herzegovina; preparing documentation for sessions of the Agency Board of Directors; preparing proposals of decisions and findings for sessions of the Agency Board of Directors, supporting professional and administrative training; developing and improving communication and cooperation between the Agency, entity agencies for supervision of insurance companies, insurers associations, actuarial associations, Green Card Bureaus and other institutions specialized in insurance in Bosnia and Herzegovina and insurance related institutions, as well as organizations in the region and in the European Union countries; addressing the issues of insurance of export credit to exporters established in Bosnia and Herzegovina. 

 

III MANAGING

 

Article 6.
(Managing the Agency) 

 

The Agency shall be headed by the Director of the Agency. Should the Director be absent or hampered from performing his or her duties, the Agency shall be run by the civil servant authorized by the Director in writing. 

 

Article 7.
(Director’s Rights and Responsibilities) 

 

Director’s rights and responsibilities are defined by the Law on Insurance Agency of Bosnia and Herzegovina, Law on Ministries and other Authorities, Law on Administration and other laws of Bosnia and Herzegovina 

 

Article 8.
(Director’s Authority) 

 

(1) Director shall issue orders on the use of funds necessary for the Agency’s operations. Acts passed by the Agency, within its jurisdiction, shall be signed by the Director. Acts which are to be pre-approved by the Board of Directors shall be signed by the Director upon the adoption of the acts by the Board of Directors.

(2) Director may authorize head civil servants of the Agency to sign acts, within Agency’s jurisdiction, which he or she shall pass a separate decision on.  

 

Article 9.
(Establishing Committees, Working Groups, Working Parties) 

 

For the purpose of performing the most complex tasks within the Agency, which require joint activities of employees from two or more organizational units of the Agency, it shall be possible to establish committees, working groups and other working parties on a permanent or temporary basis. Tasks, deadlines and composition of the committees, working groups or working parties shall be defined by the Director. The decision on appointment of the committees, working groups or working parties and their tasks and deadlines shall be made by the Director.  

 

IV WORK PLAN AND TASK PERFORMING

 

Article 10.
(Agency’s Work Plan) 

 

The Director of the Agency shall create work plan upon the approval of the Board of Directors and adoption by the Council of Ministers of Bosnia and Herzegovina. The work plan shall include one-year activities within the Agency’s jurisdiction in accordance with the work plan of the Council of Ministers of Bosnia and Herzegovina and with policies defined by the Council of Ministers of Bosnia and Herzegovina. Monthly work plans of the Agency shall be based on the adopted work plan. Monthly plans shall include schedule, dynamics, key staff members and other requirements necessary to perform tasks and implement the plan, as well as special tasks defined by the Council of Ministers of Bosnia and Herzegovina, i.e. the Board of Directors. 

 

Article 11.
(Cooperation) 

 

The Agency shall cooperate with relevant national institutions – Ministry of finance and Treasury of Bosnia and Herzegovina, entity ministries of finance, entity insurance agencies, insurance companies, associations of insurers, actuarial associations, Green Card Bureaus, offices for financial audits, etc. The Agency shall cooperate with relevant institutions for insurance of the countries in the region, European Union countries, as well as with the international organizations, for the purpose of exchange of experience and expertise. Also, the Agency shall cooperate with the insurance companies in terms of providing expert assistance and cooperation with associations and other institutions.
 

Article 12.
(Cooperation with Official Gazettes in Bosnia and Herzegovina)


The Agency shall have an ongoing cooperation with official gazettes in Bosnia and Herzegovina and shall exchange published insurance related information and acts, as well as improve and upgrade information system in insurance field.

VI SYSTEMATIZATION OF STAFF POSITIONS

 

Article 14.
(Systematization of Staff Positions within the Agency)

 

01-Agency Director 

 

The Agency Director performs managerial tasks and is responsible for the use of financial, tangible and human resources within the Agency. Director performs duties defined by law or other applicable regulations. Implements policies adopted by the Council of Ministers of Bosnia and Herzegovina and other relevant institutions. Runs and supervises the Agency in order to provide legality, transparency, publicity, cost efficiency and business impartiality of the Agency’s activities. Enables meeting high standards and professionalism in performing of duties and tasks with rational usage of working hours, controls the quality and verifies performance. Enables even distribution of tasks, optimal use of financial and other resources. Manages and coordinates activities of the head civil servants in terms of planning of tasks and duties, particularly creation of work plan and financial plan, and monitors their application. Creates or participates in defining of tasks and structure of committees, working groups, etc. Participates in preparation of Board of Directors sessions, in activities of Board of Directors sessions, and provides unhindered activities of the Board of Directors. Reports to Agency Board of Directors and Council of Ministers of Bosnia and Herzegovina on all issues relevant for the Agency’s activities. Submits, via Agency’s Board of Directors, annual reports to the Council of Ministers of Bosnia and Herzegovina in accordance with the Law. Enables Agency’s mandate to draft proposals for amendments to the Law and by-laws on insurance in Bosnia and Herzegovina in order to provide their efficiency and functionality. Enables and organizes quality technical and advisory assistance provided by the Agency to all insurance market participants. The Director is responsible for organization and performing of all other tasks arising from the Agency’s mandate as defined by Law. He or she is responsible for developing of cooperation with relevant institutions in Bosnia and Herzegovina in order to provide and improve the insurance system (Ministry of Finance and Treasury of Bosnia and Herzegovina, entity ministries of finance, entity insurance agencies, insurance companies, associations of insurers, Green Card Bureau, audit departments, Official Gazette of Bosnia and Herzegovina, etc.). Develops cooperation, enables exchange of experience and applicable cooperation with the similar institutions authorized for insurance in other countries, European Commission, relevant international organizations, etc. Enables appropriate representation and cooperation of Bosnia and Herzegovina at the international insurance level. Ensures regular monitoring of relevant information, of similar institutions in other countries and of European Court of Justice.  In accordance with the general policy of integration of Bosnia and Herzegovina into European Union, and with the whole process of stabilization and association with the European Union, coordinates harmonization of Bosnia and Herzegovina insurance laws with the corresponding legislation of European Union. Performs other duties assigned by the Agency Board of Directors and Council of Ministers of Bosnia and Herzegovina, as well as any other duties as defined by law, by-laws and other regulations.

 

REQUIREMENTS:

- Degree in Economics or Law degree

- at least 5 years of work experience

- passed state exam

- knowledge of English language

- computer skills,

- experience in international cooperation,

- good communication skills,

- experience in financial sector, and

- relevant knowledge of European Union Law.

 

OFFICIAL TITLE: Director

STATUS: Secretary with special authority

02 – Department of Legal, Administrative and Operational Affairs 2.1. Head of Legal, Administrative and Operational Affairs

 

The Head of Department manages, coordinates and participates in the activities of the Department, and provides efficient, legal, impartial, timely and responsible performing of duties within the Department. Performs the most complex tasks and is responsible for rational and lawful use of financial, tangible and human resources within the Department.  The Head is responsible for monitoring of insurance related legislation. Drafts amendments to the insurance law and proposals for insurance related acts.   He or she is responsible for preparation and publishing of rulebooks and instructions, standard forms and models, providing technical and advisory assistance to insurance companies and other insurance related institutions pertaining to application of by-laws. He or she is responsible for establishing of the system of monitoring, gathering and analysis of the insurance related information. The Head is responsible for preparation and implementation of the training program, in which the Head participates, as required. He or she is responsible for providing of equal legal protection to the insurers and the third party – claimants on the territory of Bosnia and Herzegovina. Resolves disputes between the insurance supervision agencies related to uniform implementation of the insurance legislation at the entities and Brcko District levels. Provides written declarations and opinions to ensure uniform implementation of the insurance legislation, prepares acts, develops and improves communication between the Agency, entity insurance supervision agencies, insurers’ associations, actuarial associations, Green Card Bureaus and other specialized insurance related institutions in Bosnia and Herzegovina, in the region and with the European Union countries. Prepares reports and other documentation for the Council of Ministers of BiH.  Responsible to the Agency Director. Duties of the Head of Department of Legal, Administrative and Operational Affairs belong to the group of general activities, most complex legal, study and analysis, professional and operational affairs.

- passed state exam

- knowledge of English language,

- computer skills,

- relevant experience in insurance field,

- relevant knowledge of European Union law.

 

MAIN TITLE: Head of Department

STATUS: Civil Servant

NUMBER OF STAFF REQUIRED: 1 

 

2.2. Arbitration Advisor


Arbitration advisor performs the most complex tasks which require high level of expertise and independence when preparing and implementing insurance related arbitration process. Directly participates in arbitration process and dispute resolution, as well as in supervising of the made decisions. Advisor is responsible for providing of equal legal protection to the insurers and the third party – claimants on the territory of Bosnia and Herzegovina.  Resolves disputes between the insurance supervision agencies pertaining to uniform interpretation and implementation of the insurance legislation at the entities and Brcko District levels, prepares written declarations and opinions to ensure uniform implementation of the insurance legislation, prepares acts, develops and improves communication between the Agency, entity insurance supervision agencies, associations of insurers, actuarial associations, Green Card Bureaus and other institutions. Responsible for keeping and updating of records of all cases and timely preparation of statistical reports. Advisor is responsible for timely preparation of information on all cases. Performs other tasks as required by the Head of Department and Agency Director. Responsible to the Head of Department. Duties of Arbitration Advisor belong to general activities, most complex study and analysis, as well as professional and operational affairs.

2.3. Senior Associate Insurance Related Legal Affairs


Senior associate performs the most complex duties which require high level of expertise and independence in drafting of Agency’s legal acts. Participates in dispute resolution between the Insurance Supervisory Agency in terms of uniform interpretation and implementation of the laws. Participates in coordination relating to cooperation with professional service department of Council of Ministers of Bosnia and Herzegovina, entities and Brcko District. Improves communication between the Agency, entity agencies for supervision of insurance companies, association of insurers, actuarial association and Green Card Bureau. Participates in performing of tasks, particularly relating to drafting amendments to the law on insurance and proposals to insurance related acts. Participates in drafting manuals and instructions, communication, standard forms and models, and particularly in providing technical and advisory assistance for insurance beneficiaries in terms of law and by-laws application. Participates in gathering and analyzing of the insurance related information. Monitors other insurance related regulations, and performs other tasks as required by the Head of Department and Agency Director. Responsible to the Head of Department. Activities of the senior research associate in charge of normative and legal affairs activities belong to general activities, most complex legal affairs, study and analysis, professional and operational affairs.

2.4. Associate - Insurance Related Legal Affairs

 

Associate performs complex duties which require high level of expertise and independence in drafting of Agency’s legal acts. Participates in drafting of manuals and instructions, communication, standard forms and models, and particularly in providing technical and advisory assistance for insurance beneficiaries in terms of law and by-laws application, and participates in gathering and analyzing of the insurance related information. Monitors other insurance related regulations, and supervises the process of insurance related regulations implementation. Prepares acts on labor related legal affairs of the Agency’s employees. Performs other tasks as required by the Head of Department and Agency Director. Associate is responsible to the Head of Department. Activities of the associate in charge of legal affairs in public procurement field belong to general activities, complex legal affairs, professional and operational affairs.

2.5 Administrative and Operational Officer


Administrative and Operational Officer performs administrative and other duties relating to the functioning of the Agency, receives, completes, sorts, records and archives documentation submitted to the Agency. Performs secretarial duties for the Agency Director and provides technical and other conditions for the preparation and holding of Agency Director meetings. Assists the head of the Agency by managing his or her timetable, organizes meetings, takes minutes at meetings, coordinates preparation of documents for meetings and interviews, provides preparation/drafting, proofreading and copying of documents, organizes official visits in the country and abroad, as well as reception of national and international visitors.  Officer is in charge of cashier affairs and enables flow of information within the Agency by performing of professional and technical tasks, such as answering and redirecting telephone calls, receiving, distributing and sending mail, taking records on received and sent correspondence, archiving all documentation developed and received by the Agency, and performing other duties as required by the Head of Department and Agency Director, or by other employees of the Agency. Officer is responsible to the Head of Department and Agency Director. Activities of the Administrative and Operational Officer belong to general activities, rather simple administrative and technical affairs.

 

REQUIREMENTS:

- Secondary Education – III or IV classes completed, general or  vocational school

- at least 1 year of work experience,

- computer skills- knowledge of English language or some other European Union language.

03 – Department of International Cooperation, Finance, Statistics and Actuarial Activities
 

3.1. Head of Department of International Cooperation, Finance, Statistics and Actuarial Activities 

 

The Head of Department of International Cooperation, Finance, Statistics and Actuarial Activities manages, coordinates and participates in the activities of the Department, and provides efficient, legal, impartial, timely and responsible performing of duties within the Department. Performs most complex tasks and is responsible for rational and lawful use of financial, tangible and human resources within the Department.  He or she is responsible for preparation of reports within the Department’s jurisdiction. Performs other duties as required by the Agency Director. Establishes continuous cooperation with the “Official Gazette of Bosnia and Herzegovina” Public Company. Drafts amendments to the insurance law and proposals for insurance related acts. The Head is responsible for preparation and publishing of rulebooks and instructions, standard forms and models, providing technical and advisory assistance to insurance companies and other insurance related institutions pertaining to application and interpretation of by-laws. He or she is responsible for providing any information to be requested by the European Union pertaining to the law and best practices in insurance in Bosnia and Herzegovina in order to evaluate harmonization of the laws in Bosnia and Herzegovina with the European Union standards.  He or she is in charge of managing investigations and monitoring in compliance with the law. The Head is responsible for cooperation in exchange of information with relevant authorities from other countries, preparation of information and delivery of information to entity agencies, cooperation with the Green Card Bureau of Bosnia and Herzegovina, improvement of insurance statistics, keeping statistics on insurance market operations in Bosnia and Herzegovina, submitting statistical reports to European Commission or insurance related international organizations on behalf of Bosnia and Herzegovina, preparation of information and reports on insurance statistics to the Council of Ministers of Bosnia and Herzegovina, as well as to other relevant institutions, monitoring and preparing up-to-date insurance related analyses on a regular basis for all levels of government in Bosnia and Herzegovina. Prepares instructions, declarations and findings of the Agency, provides support to professional and administrative training, as required, in order to develop and improve communication between the Agency, entity agencies for supervision of insurance companies, associations of insurers, actuarial associations, Green Card Bureau and other specialized institutions in the field of insurance in Bosnia and Herzegovina, in the region and European Union countries. The Head is responsible for tasks relating to insurance of export credits offered to exporters in Bosnia and Herzegovina, financial and material operations of the Agency, and has daily consultations with the Treasury Department and other relevant institutions. Prepares proposal for the Agency budget, annual financial statements and interim statement of accounts. Prepares financial statements for the Agency’s Board of Directors, is responsible for the documentation on the Agency’s property. He or she is responsible for organization of Agency’s archives, and performs tasks relating to human resources management. The Head is responsible to the Agency Director. Activities of the Head of Department of International Cooperation, Finance, Statistics and Actuarial Activities belong to general activities, most complex information and documentation related affairs, study and analysis, professional and operational activities.

3.2. International Cooperation Advisor

 

International Cooperation Advisor for insurance performs complex tasks which require high level of insurance related expertise and fluency in English language. Prepares instructions, declarations and findings of the Agency, provides support to professional and administrative training, as required, in order to develop and improve communication between the Agency, entity agencies for supervision of insurance companies, associations of insurers, actuarial associations, Green Card Bureau and other specialized institutions in the field of insurance in Bosnia and Herzegovina, in the region and European Union countries. Performs duties relating to insurance of export credit offered to exporters in Bosnia and Herzegovina. Participates in preparation of reports in order to ensure adequate availability of insurance sector statistics. Participates in monitoring and timely announcement of insurance notifications. Performs other duties as required by the Head of Department and Agency Director. Advisor is responsible to the Head of Department. Activities of the International Cooperation Advisor belong to general activities, most complex information technology and documentation, as well as professional and operational affairs.

3.3. Senior Associate - Finance and Statistics


Senior Associate performs most complex duties which require high level of expertise and independence in preparation of acts in the field of financial transactions of the Agency. Senior Associate is in charge of financial and material affairs of the Agency, and has daily consultations with the Treasury Department and other relevant institutions. Participates in preparations for the Agency draft budget, participates in preparations for annual financial statements and interim statement of accounts. Prepares financial statements for the Agency Board of Directors and is responsible for the documentation on the Agency’s property. He or she is responsible for organization of Agency’s archives and performs tasks relating to human resources management. Associate is responsible to the Head of Department and Agency Director. He or she is responsible for cooperation in exchange of information with relevant authorities from other countries, preparation of information and delivery of information to entity agencies, cooperation with the Green Card Bureau of Bosnia and Herzegovina, improvement of insurance statistics, keeping statistics on insurance market operations in Bosnia and Herzegovina, submitting statistical reports to European Commission or insurance related international organizations on behalf of Bosnia and Herzegovina, preparation of information and reports on insurance statistics to the Council of Ministers of Bosnia and Herzegovina, as well as other relevant institutions, monitoring and preparation or up-to-date insurance related analyses on a regular basis for all levels of government in Bosnia and Herzegovina. 3.4. Senior Finance Associate 


Senior Finance Associate performs most complex duties which require high level of expertise and independence in preparation of acts in the field of financial transactions of the Agency. Prepares instructions, declarations and findings of the Agency, provides support to professional and administrative training, as required, in order to develop and improve communication between the Agency, entity agencies for supervision of insurance companies, associations of insurers, actuarial associations, Green Card Bureau and other specialized institutions in the field of insurance in Bosnia and Herzegovina, in the region and European Union countries. Senior associate is responsible for tasks relating to insurance of export credits offered to exporters in Bosnia and Herzegovina, financial and material operations of the Agency, and has daily consultations with the Treasury Department and other relevant institutions. Prepares Agency draft budget, annual financial statements and interim statement of accounts. Prepares financial statements for the Agency Board of Directors and is responsible for the documentation on the Agency’s property. He or she is responsible for organization of Agency’s archives, performs tasks relating to human resources management. Performs other duties as required by the Head of Department and Agency Director. Associate is responsible to the Head of Department. 3.5. Statistics Associate


Statistics Associate is responsible for cooperation in exchange of information with relevant authorities from other countries, preparation of information and delivery of information to entity agencies, cooperation with the Green Card Bureau of Bosnia and Herzegovina, improvement of insurance statistics, keeping statistics on insurance market operations in Bosnia and Herzegovina, submitting statistical reports to European Commission or insurance related international organizations on behalf of Bosnia and Herzegovina, preparation of information and reports on insurance statistics for the Council of Ministers of Bosnia and Herzegovina, as well as other relevant institutions, monitoring and preparation of up-to-date insurance related analyses on a regular basis for all levels of government in Bosnia and Herzegovina. Associate is responsible to the Head of Department. Activities of the finance associate belong to general activities, most complex study and analysis related activities, professional and operational affairs.

VII EMPLOYMENT AND DISCIPLINARY RESPONSIBILITIES

 

Article 15.
(Responsibility of civil servants and employees)

 

(1) Civil servants and employees within the departments shall be responsible to the Head of Department, i.e. to Director.

(2) Heads of Departments shall be responsible to Director.

(3) Civil servants shall be held disciplinary accountable in compliance with the Law on Civil Service in the Institutions of Bosnia and Herzegovina and regulation of the Council of Ministers on Disciplinary Responsibility of Civil Servants

(4) Disciplinary action shall be taken against employees in compliance with the Labor Law within the Institutions of Bosnia and Herzegovina (hereinafter: Labor Law) and regulation of Council of Ministers on Disciplinary responsibility of employees.

(5) Civil servants and employees shall be held financially responsible in compliance with the Labor Law and regulations on financial responsibility within the institutions of Bosnia and Herzegovina.   

 

Article 16.
(Employment)


In compliance with the Law on Civil Service and corresponding by-laws civil servants shall be employed in the Institutions of Bosnia and Herzegovina. Trainees and employees shall be recruited in compliance with the Labor Law, the Decision on Requirements and Manner of Employment of Trainees with University Degree with the Institutions of Bosnia and Herzegovina (“Official Gazette of BiH”, number 52/05), and provisions of this Rulebook unless the Decision on Requirements and Manner of Employment of Trainees with University Degree with the Institutions of Bosnia and Herzegovina otherwise prescribes.  The Agency, by rule, recruits one trainee, in addition to the positions defined by the Systematization of Staff Positions. In exceptional cases, the Director, with previous approval given by the Board of Director, may recruit more than one trainee.

 

Article 17.
(Employment Requirements)


(1) Trainee with university degree – Level VII shall be employed for one year, whereas a trainee with lower education level shall be employed for six months.

(2) Employee shall be employed indefinitely.

(3) Employee may be employed temporarily by signing a contract only in cases prescribed by Article 16 paragraph 2 of the Labor Law in Institutions of Bosnia and Herzegovina.

(4) Trainee and employee shall be employed only by means of public advertisement, except in cases prescribed by Article 9 of the Labor Law in Institutions of Bosnia and Herzegovina.

(5) Trainee and employee may be employed if they meet the general and special requirements.

General requirements for employment of trainees and employees are stipulated by the Labor Law in Institutions of Bosnia and Herzegovina, whereas special requirements are stipulated as follows:

a) for trainees – by decision on the need for employment made in accordance with Article 8 paragraph 1 of the Labor Law;

b) for employees – by this Rulebook, that is, by systematization of staff positions. 

 

Article 18.
(Vacancy Advertisement)


Vacancy advertisement for recruitment of trainees and employees shall be published in at least one high circulation daily newspaper which may be bought in the whole territory of Bosnia and Herzegovina and read on the Agency’s official website. Should the advertisement medium selected through public bidding be the daily newspaper, the advertisement may be published in the selected newspaper only. The advertisement should include general and special requirements in compliance with Article 16 of the Rulebook, manner of selection of candidates, necessary documents, deadline for applying (no less than eight or longer than 15 days), as well as where and how to deliver relevant documents, and any other necessary information.
 

Article 19.
(Committee’s Activities)


(1) Vacancy advertisement for recruitment of trainees or employees shall be managed by the committee comprising the Head and two members, who are selected among civil servants, i.e. employees of the Agency, by the Director, separately for each advertisement. The Head of the Committee shall manage the Committee’s activities and sign all Committee’s acts, which shall be verified with Agency’s seal, if required. (2) The Committee shall consider received applications and define the order of candidates in accordance with requirement issued in advertisement and demonstrated knowledge of the candidates in relevant issues. Incomplete and untimely applications or applications which do not meet the requirements issued in advertisement shall not be taken into consideration by the Committee, and the applicants who submitted such applications shall be informed on. The decision on how to test and grade the knowledge of the candidates shall be made by the Committee, in accordance with the decision on the Committee appointment
 

Article 20.
(Selection of Candidates)


(1) Decision on selection of candidates shall be made by the Director, in accordance with the proposal given by the Committee and with earlier approval given by the Board of Directors. Based on such decision, the employment contract shall be signed with trainee or with employee. Other candidates shall be informed about the selected candidates for the job with brief explanation about the reasons for employment of selected candidate. Any candidate who believes that the implementation of the vacancy advertisement procedure has violated provisions of the Law or Rulebook, may file a complaint to the Director no later than 15 days from the day of the received notification from item 3 of this Article.

(2) The Director shall manage the complaint in compliance with the principles of the Law on Administrative Procedure (“Official Gazette of BiH”, numbers 29/02 and 12/04).

(3) Decision on complaint is final and it may be appealed by initiating of the administrative procedure before the Court of BiH in compliance with the provisions of the Law on Administrative Procedure of BiH, no later than 30 days from the day of issuing the decision.
 

Article 21.
(Trainee’s Activities)


The trainee shall be entitled to salary corresponding to the lowest salary class in accordance with the education level decreased by 20%, and to all other rights, which, in accordance with the rules and regulations, all employees are entitled to regardless of their education level.  A civil servant shall be appointed to supervise the activities of trainee, and shall act in the capacity of the Head of the Department, as trainee’s immediate superior. The trainee shall be given the option to take the state exam in accordance with the rules and regulations, at least three months prior to the end of status of trainee.


VIII TRANSITIONAL AND FINAL PROVISIONS

 

Article 22.
(Professional Training of Civil Servants and Employees)


(1) The Agency Director, with approval given by the Board of Directors, shall develop the Rulebook on program and schedule of professional training of Agency employees, as well as in terms of learning English language or one of the European Union languages. (2) Covering the costs of professional training shall be defined by the Rulebook from previous paragraph.
 

Article 23.
(Amendments to Rulebook)


Amendments to the Rulebook shall be made in the same manner as during the procedure of the Rulebook passing.
 

Article 24.
(Entry into Force)

 

The Rulebook shall enter into force on the day of the approval given by the Council of Ministers of Bosnia and Herzegovina.

RATIONALE BEHIND THE RULEBOOK ON INTERNAL ORGANIZATION AND SYSTEMATIZATION OF STAFF POSITIONS WITHIN THE INSURANCE AGENCY OF BOSNIA AND HERZEGOVINA
 

I – LEGAL BASIS FOR RULEBOOK


Legal basis for Rulebook on Internal Organization and Systematization of Staff Positions within the Insurance Agency of Bosnia and Herzegovina is included in Article 4 of the Law on Insurance Agency of Bosnia and Herzegovina (“Official Gazette of BiH”, number 12/04), articles 52 and 53 of the Law on Administration (Official Gazette of BiH, number 32/02) and provisions of the Decision on General Activities and Sideline Operational Activities and requirements for performance of such activities within the administration bodies of the institutions of Bosnia and Herzegovina and Decision on Principles of Defining Internal Organization of the Administration of Bosnia and Herzegovina Institutions (“Official Gazette of BiH”, number 12/03).  
 

II – GROUNDS FOR DEVELOPINGTHE RULEBOOK


The Law on Insurance Agency in Bosnia and Herzegovina (“Official Gazette of BiH”, number 12/04) established the Insurance Agency in Bosnia and Herzegovina. Article 4 of the aforesaid Law stipulates the responsibility of the Agency Board of Directors to, no later than three months from the day of establishing the Agency, pass the acts to regulate general and administrative duties, and authorization for decision making and equal status of the employees. Following the appointment procedure, the Agency Director made a draft Rulebook, which was passed by the Agency’s Board of Directors on the session held on 30 August 2006. Following the approval of the Rulebook by the Council of Ministers of BiH, vacancies shall be filled and the Agency shall be completely functional.  

 

III – RATIONALE BEHIND THE PROPOSED SOLUTIONS

 

The Rulebook is made in compliance with item XLII of the Decision on Principles for Defining Internal Organization of the Administration of Bosnia and Herzegovina Institutions (“Official Gazette of BiH”, number 12/03).

The Rulebook contains eight chapters: I – General Provisions; II – Organizational Units and Their Jurisdiction; III – Managing; IV – Work Plan and Task Performing; V – Total Number of Civil Servants and Employees; VI – Systematization of Staff Positions; VII Employment and Disciplinary Responsibilities; VIII  -  Transitional and Final Provisions.Rulebook stipulates 11 staff members – 1 head civil servant, 9 civil servants and 1 employee.
 

IV – NECESSARY FUNDS


Funds from the budget of the Institutions of Bosnia and Herzegovina and international commitments of Bosnia and Herzegovina for 2006 have been provided in order to implement the Rulebook.  In 2006, the vacancies shall be filled in accordance with approved funds.
